Paternity is a legal term for fatherhood.  Paternity establishes the identity of the biological father of a child born out of wedlock and obligates him to contribute financial support for the child.  A paternity lawsuit may be brought by the mother, the presumed father, the child (if he or she is underage, a representative must act on his or her behalf), a relative taking care of the child or in certain circumstances, a government agency.


Legitimation establishes a legal relationship between the biological father and the child born out of wedlock.   Legitimation gives the father the right to petition for custody of and visitation with the child.  It also give the child the right to inherit from the father, the right to obtain family medical history on the father’s side and the right to placement in the home of a relative on the father’s side in the event that the mother becomes unable to care for the child.  A petition for legitimation may only be filed by the biological father.
